Tembeka Ngcukaitobi (born 25 December 1976 in Western Cape) is a South African lawyer. He currently sits on the position of the advocate of the high court.

He received a nomination from the Johannesburg bar to senior counsel in 2019. The attorney has made a name for himself through his legal profession.

In the field, he is considered among the brilliant advocates which he earned through the role he played in the scandal of Jacob Zuma.

He was born Tembeka Nicholas Ngcukaitobi on 25 December 1976 in Western Cape. Though he hails from a humble beginning, he made a quick rise in the country’s legal system.


He had his undergraduate studies at the University of Transkei.

During the beginning of his profession, he was a law clerk to Chief Justice Arthur Chaskalson at the Constitutional Court of South Africa.

He also worked as a candidate attorney at the Legal Resources Center. Later, he climbed to the Director of its Constitutional Litigation Unit.


He is a BProc, LLB degree holder from the University of Transkei (Unitra). Tembeka graduated from Rhodes University with a Masters of Law, LLM. 

He also holds a Masters of Law, LLM from the London School of Economics. Tembeka became a senior counsel in 2019 after practicing law as an advocate for eight years.


Tembeka’s interest in the profession could be traced down to his knowledge that his father died when he was a law student at UNISA.

Then he started his profession at the Constitutional Court of South Africa. There he was a law clerk for Chief Justice Arthur Chaskalson.

He landed the position of Candidate Attorney at the Legal Resources Center. Eventually, he became the Director of its Constitutional Litigation Unit.

He served as the acting Judge at the Land Claims Court of South Africa in 2021. He is also an advocate of the High Court.

Tembeka played a notable role in the scandal of ex-president Jacob Zuma. He recorded major career achievements in 2019 when he received a nomination by the Johannesburg bar to become a senior counsel.

The position demands an experience of a decade to fifteen years of experience. But he had only eight years of experience at that time.
